Wild Nectar Collection, as a Travel Agency only acts as an intermediary between Users and the entities or persons providing air or land transport services, accommodation, food, or any other service contracted through this website, hereinafter “the Suppliers”. The User expressly acknowledges that Wild Nectar Collection acts as an intermediary in the contracting of products related to accommodation and accepts the contracting conditions from the Supplier in additions to these Terms and Conditions.

 

Suppliers directly own, manage or make available travel products. You are responsible for accepting and understanding the terms and conditions and privacy policies of the Supplier that provides your reservations, accommodations or services. You are responsible for any interaction between you and the Suppliers that you have access to through this website. Wild Nectar Collection is not responsible for any costs, damages, losses or inconvenience  that may arise with your reservation or your trip provided by the Suppliers.

Displaying Suppliers’ offers does not in any way imply, suggest or constitute a recommendation for use by Wild Nectar Collection. Also, Wild Nectar Collection is not responsible that the content provided by the Suppliers is accurate, updated or complete, and, therefore, does not guarantee the prices shown on this website. Prices vary constantly, additional charges may apply (service charges, baggage fees, fuel surcharges, and local taxes and fees). Always verify that the prices are as expected, before completing the reservation. The User expressly agrees to pay the charges for cancellation or change in the reservation as indicated in the rules and restrictions of the booking made with the Supplier.

 

Wild Nectar Collection is not responsible for non-compliance of Suppliers in the performance of their obligations, or unforeseen events caused by cases beyond the control of Wild Nectar Collection, of force majeure or unforeseen circumstances, such as but not limited to strikes, weather conditions, delays, earthquakes, pandemic, outbreak, political factors, denial of entry permits, issues of health, as well as for material, personal or moral damages that the User may suffer due to loss, damage or theft of luggage, nor due to accidents, illnesses or deaths. The User agrees that in the event of a force majeure event, the Supplier and/or Wild Nectar Collection may modify, replace or cancel itineraries, dates, flights, hotels, prices or optional services. Users must make any claim directly to the Suppliers and providers of the breached service. Wild Nectar Collection will assist the User with this process as soon as possible.

Users agree to comply with the obligations on travel documents, such as visas, permits to leave the country for minors, weight, and content of luggage and other cargo, the validity of passports, visas, driving licenses, etc. All obligations are the responsibility of the User, so they waive all claims against Wild Nectar Collection. Users agree that additional Terms and Conditions may apply to reservations, purchase of goods and services, and to other sections of this website, depending on the specific Supplier.

7. Claims

​

Claims generated the provision of the services offered and acquired by Wild Nectar Collection must be made through electronic means, using the mechanisms implemented on this website or through written communication up to a maximum period of two years after the services.

8. Cancellations, Modifications, or Refunds

​

For any cancellations, modifications or refunds of a service requested by the User, User agrees and accepts these Terms and Conditions, policies, terms, penalties and availability of the Suppliers and Wild Nectar Collection. Any expenses, including but not limited to penalties, charges, changes, differences, and date changes will be paid by the User.

Due to external factors to the Supplier in products that may include air travel, such as weather conditions, operations, internal problems at the place of operation of the flight, etc., it is not possible to schedule the flight on the planned day, the date will be rescheduled again without the option to refund money and in the event that additional nights of stay are generated at the destination, expressly accepts to be assumed by the client.

Reimbursement policies for services not provided due to force majeure or unforeseeable circumstances, action or omission of third parties or the passenger, which are beyond the control of Suppliers or Wild Nectar Collection, before or during the trip, , will be defined for each Supplier, as well as the percentages of penalties or deductions that may be applicable. Wild Nectar Collection is not liable for any amounts requested in reimbursement by the User.

In addition, Wild Nectar Collection will not refund or return any expenses that the Suppliers have already incurred as a result of the reservation and, consequently, are not returned to the User. These costs. These expenses, if required by the client, will be supported by a written document from the Supplier.

8. Initial Payments

​

For those products that require the payment of a certain sum for the reservation and blocking of spaces, that amount will be non-refundable and will not be refundable under any circumstances.

​

9. Waiver

​

User may visit a location using reservations or advice of WILD NECTAR COLLECTION (each, a “Location”) AND USER ACKNOWLEDGES AND AGREES THAT ANY VISIT TO THE LOCATION BY OR AT THE REQUEST OR DIRECTION OF USER IS SOLELY AT USER’S RISK AND USER SHALL ASSURE THAT USER COMPLIES WITH ALL APPLICABLE PHYSICAL DISTANCING AND MASKING GUIDELINES.  RECOGNIZING THE COVID-19 RISKS INHERENT IN TODAY’S WORLD, USER SPECIFICALLY RELEASES, DISCHARGES AND AGREES TO INDEMNIFY, DEFEND, AND HOLD HARMLESS WILD NECTAR COLLECTION AND WILD NECTAR COLLECTION’S AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, PROFESSIONAL ADVISORS, AND CONTRACTORS (EACH A “RELEASED PARTY” HEREUNDER), FROM ANY AND ALL CLAIMS, JUDGMENTS, COSTS, DAMAGES (INCLUDING, WITHOUT LIMITATION ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL OR PUNITIVE DAMAGES), LOSSES, EXPENSES AND LIABILITIES, WHETHER UNDER CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE, STRICT LIABILITY, PRODUCT LIABILITY OR ANY OTHER THEORY), RELATING TO ANY CLAIM THAT USER, ANY EMPLOYEE, AGENT, CONTRACTOR OR OTHER INVITEE OF USER, MAY NOW OR LATER HAVE WITH RESPECT TO ANY ILLNESS, DEATH, PERSONAL INJURY, FINANCIAL OR OTHER LOSS, DAMAGE, COST OR EXPENSE THAT MAY BE SUFFERED BY USER, ANY EMPLOYEE, AGENT, CONTRACTOR OR OTHER INVITEE OF USER, OR ANY THIRD PARTY WITHIN ANY OF THEIR HOUSEHOLDS AS A RESULT OF EXPOSURE TO THE NOVEL CORONAVIRUS THAT CAUSES THE DISEASE COVID-19 IN CONNECTION WITH VISITS TO THE LOCATION.

10. Limitations of Personal and Commercial Use

Users may only access this website to make authentic reservations or purchases, and cannot be used for other purposes than those described here. No speculative, false or fraudulent reservations may be made and no illegal or prohibited activity in may be reserved. Users agree that they are of sufficient legal age to use the site and to accept the legal and economic obligations of your reservations. Users agree to accept all the responsibilities arising from the use of this website, whether caused by you or by third parties operating under your password (with or without your permission). You are solely responsible for maintaining the secrecy of your passwords and the information contained in your User account. All information you send us must be accurate and up-to-date.

11. Credit Card Security and Privacy

Wild Nectar Collection also provides personal information to its third-party service providers (such as developers) who assist us in providing, maintaining and advertising this website, but those third parties are bound by confidentiality agreements that prohibit unauthorized use or disclosure of the information to which they have access. Wild Nectar Collection does not sell User information or individual member names to third parties and will not do so in the future. Wild Nectar Collection will disclose personal information to government officials or legal entities when we believe in good faith that the law requires it.

The User agrees not to perform any of the following acts:

5. e) Collect, store, publish or distribute data from or about third parties.

8. h) Use terms or expressions that are abusive, intimidating, slanderous, or contrary to good manners.

15. Jurisdiction and Legal Competence

Wild Nectar Collection reserves the right to modify, at any time, these terms and conditions, or introduce new terms and conditions, use and responsibilities, by changing these Terms & Conditions on their website. These modifications will apply to all Users when continuing to use the website and contracted services.

Wild Nectar Collection Cancellation Policy

​

In the event that a trip Supplier does not have a cancellation policy, User agrees to the following Wild Nectar Collection cancellation policy:

​

• For all cancellations where Wild Nectar Collection is notified and the cancellation is processed 121 or more calendar days prior to departure, Users will forfeit all deposits, but all upcoming charges will not be invoiced.

​

• Cancellations made 61 to 120 calendar days prior to departure are assessed a cancellation fee of 50% of the entire trip price, including internal air, extensions, and extra services such as hotel nights. The User will have been notified, at time of booking, or at another time before the trip, that some flights or services may be non-refundable.

​

• Cancellations made 60 calendar days or less prior to departure are assessed a cancellation fee of 100% of the trip price, including everything provided or arranged by Wild Nectar Collection and Suppliers, including but not limited to all airfare, hotel, extensions, excursions, and extra services such as hotel nights.

​

 

BY USING OUR SITE or PURCHASING FROM US, USER ACCEPTS THESE TERMS AND CONDITIONS AND AGREES TO ABIDE BY THEM. THE THE USER(S) HAVE BEEN NOTIFIED AND AGREE TO  THESE TERMS AND CONDITIONS.
